1. Introduction

This Refund Policy outlines the terms under which BW Performance UK ("we", "us", or "our") offers refunds, cancellations, or returns for products or services purchased through www.bwperformanceuk.co.uk (the "Website"). We are committed to complying with your rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

 

2. Cancellations

2.1 Consumer Right to Cancel (Distance Sales)

Under the Consumer Contracts Regulations 2013, if you are a consumer purchasing goods or services online, you have the right to cancel your order within 14 days without giving a reason. The cancellation period begins:

  • For goods: The day you (or someone you nominate) receive the goods.

  • For services: The day the contract is entered into (e.g., when you place the order).

To cancel, you must inform us of your decision to cancel within the 14-day period by contacting us at:

You may use the model cancellation form provided in the Consumer Contracts Regulations 2013, but this is not mandatory. A clear statement of your intent to cancel will suffice.

2.2 Exceptions to the Right to Cancel

The right to cancel does not apply to:

  • Services that have been fully performed, if you agreed to performance starting before the end of the 14-day period and acknowledged that this would waive your right to cancel.

  • Custom-made or personalised goods.

  • Goods that are liable to deteriorate or expire rapidly.

  • Sealed goods that are not suitable for return due to health or hygiene reasons, if unsealed after delivery.

 

3. Returns

If you exercise your right to cancel, you must return any goods to us within 14 days of notifying us of your cancellation. Goods must be unused, in their original condition, and in their original packaging. You are responsible for the cost of return shipping unless the goods are faulty or misdescribed.

4. Refunds

4.1 Refund Process

If you cancel your order within the 14-day period and comply with the return requirements (if applicable), we will issue a refund for the full amount paid, including any standard delivery costs (but not additional costs for premium delivery options). Refunds will be processed within 14 days of:

  • Receiving the returned goods, or

  • Receiving proof that the goods have been sent back (whichever is earlier), or

  • For services, the date you notify us of cancellation (if no goods are involved).

Refunds will be made using the same payment method used for the original purchase, unless otherwise agreed.

4.2 Faulty or Misdescribed Goods

If goods are faulty, not as described, or not fit for purpose, you are entitled to a refund, repair, or replacement under the Consumer Rights Act 2015. Please contact us within 30 days of receiving the goods to report the issue. We will cover the cost of returning faulty or misdescribed goods and process a refund or replacement within 14 days of receipt.

4.3 Non-Returnable Goods

No refunds will be issued for goods that are custom-made, personalised, or excluded under the Consumer Contracts Regulations 2013 (see Section 2.2), unless they are faulty or misdescribed.

 

5. Services

If you purchase a service (e.g., performance coaching or training sessions) and cancel 24 hours or fewer than when the service was due to commence, no refund will be issued. All cancellations that occur more than 24 hours prior to the start time of the service will be entitled to a full refund. Exceptional circumstances for sessions cancelled less than 24 hours before the session start time maybe considered for refund at the coach's ruling.
